Candidate Privacy Notice

1. Introduction

We appreciate your interest in joining Valence. Your privacy is important to us. This Candidate Privacy Notice ("Privacy Notice") explains the types of personal information we collect, use, and store in connection with our application and recruitment processes, how we manage that information, and your rights with respect to it.

2. Applicability

This Privacy Notice applies to individuals who apply to or are interviewed for jobs at Get Pegasus Inc. and its affiliates (collectively, "Valence"). It does not apply to your use of Valence's products or services — for that, please refer to our Privacy Policy.

3. Personal Data We Collect

We collect personal data: (1) that you provide us directly; (2) that we collect automatically; and (3) from third parties.

A. Personal Data You Provide Us

  • Contact information — name, email, phone number, location
  • Employment and education information — current and past employers, job titles, resume or CV, education, desired compensation, job preferences
  • Application materials — cover letters, portfolio links, writing samples, assessments
  • Sensitive personal data — citizenship or immigration status, and voluntary demographic data you choose to provide (e.g., race, ethnicity, gender, or accommodation-related health information)
  • Audio and video recordings and transcriptions from interviews
  • Communications — emails or messages exchanged during the process
  • Other information you provide during interviews or screening calls
  • Inferences drawn from the above

We do not require access to personal social media accounts or personal account credentials at any stage of the hiring process.

B. Personal Data We Collect Automatically

When you visit our careers page, we may collect technical data such as IP address, browser type, and site interaction data via cookies and similar technologies.

C. Personal Data We Collect from Third Parties

We may collect information from references you provide, former co-workers or employers, background check providers, and publicly available sources such as LinkedIn or personal websites you make available to us.

4. How We Use Personal Data

We use candidate personal data to:

  • Assess your skills, qualifications, and fit for our open roles (voluntary demographic data will not be considered in hiring decisions)
  • Conduct identity verification and background checks where applicable
  • Communicate with you about your application and other opportunities at Valence
  • Assist with immigration visa or work permit processes where applicable
  • Improve our recruiting processes
  • Comply with legal obligations and respond to governmental requests
  • Protect and defend our legal rights
  • Detect, prevent, and respond to fraud and security incidents

If you are offered and accept employment, information collected during the recruitment process will become part of your employment record.

5. Disclosure of Personal Data

In order to evaluate your application and candidacy for employment, we share your personal data with:

  • Our affiliates.
  • Our service providers, including those that host application information, conduct background checks, and assist us to detect, prevent, and respond to fraud and security incidents. These service providers may be located or host personal data outside the country in which you live or the country where the position you applied for is located.
  • Our investors.
  • Courts and tribunals, regulatory bodies, or local labor authorities, where required.
  • Other third parties, such as when we contact references you provide.

We do not sell candidate data.

6. Your Rights and Choices

Subject to applicable law, you may have the right to:

  • Access and receive a copy of your personal data
  • Correct inaccurate personal data
  • Request deletion of your personal data
  • Restrict or object to processing of your personal data
  • Withdraw consent where processing is based on consent

These rights may be limited where fulfilling a request would infringe the rights of a third party or where we are required by law to retain the information.

To exercise any of these rights, contact us at privacy@valence.co. We will confirm receipt and respond within the timeframe required by applicable law. We may need to verify your identity before processing your request.

Residents of the EU, EEA, Switzerland, and UK also have the right to lodge a complaint with the data protection authority in their jurisdiction.

7. International Data Transfers

Valence is a global company. Personal data we collect may be transferred to, processed, and stored in the United States and other jurisdictions where Valence or its service providers operate. Data protection laws in those jurisdictions may differ from those in your country of residence.

  • EEA transfers: We rely on Standard Contractual Clauses (SCCs) approved by the European Commission, adequacy decisions, or other recognized transfer mechanisms including the EU-U.S. Data Privacy Framework where applicable.
  • UK transfers: We rely on the UK International Data Transfer Agreement (IDTA) or the UK Addendum to the EU SCCs.
  • Switzerland transfers: We rely on applicable Swiss mechanisms under the revised Federal Act on Data Protection (revFADP).

8. Lawful Basis for Processing (EU/EEA/UK/Switzerland)

Where required, we rely on the following lawful bases:

  • Legal obligation — to comply with applicable law and regulatory requirements
  • Legitimate interests — to administer our recruiting process, detect fraud, and protect our legal rights, where those interests are not overridden by your rights
  • Contractual necessity — to take steps at your request prior to potentially entering into an employment contract
  • Consent — only where you have expressly opted in to specific optional processing (e.g., retaining your profile for future roles), which you may withdraw at any time without affecting the lawfulness of prior processing
  • Vital interests — where necessary to protect your or another person's vital interests

9. Security

We use technical, organizational, and physical measures designed to protect your personal data from unauthorized access, loss, or misuse. No electronic transmission or storage is entirely secure. If you have questions about our security practices, contact us at privacy@valence.co.

10. Retention

We retain candidate data for as long as necessary to evaluate your candidacy, protect our legal rights in the event of a dispute, or as required by law. Typically, unsuccessful application data is evaluated periodically to determine if the talent profile remains relevant to our hiring needs.

11. Changes to This Notice

We may update this Privacy Notice periodically. When we do, we will update the "Last Updated" date above. Please check this page for updates.

12. California Notice at Collection

These additional disclosures apply to California residents only.

Categories of Personal Information We Collect: Identifiers; employment and education information; demographic information; financial information (compensation preferences); internet and device activity; geolocation data; audio/visual recordings; communications; health or medical information provided for accommodations; criminal background (background check only); and inferences drawn from the above.

We do not sell or share candidate personal information as defined under California law.
